Programme:

The limits to free markets within the EU and the balance between individual freedoms and public interests: constitutional and legal framework, in the EU and the national context.

The law and governance of regulation and competition in the EU: fundamental concepts of regulatory strategies, rules and enforcement.

The role,the powers and accountability of independent competition and regulatory agencies, both within the EU and the national context. The complex relationship between competition law and regulation and the advocacy powers of competition agencies.

The function of competition law; an overview of EU and national principles of competition law.

Articles 101 and 102 TFEU: anti-competitive agreements and abuse of dominant position.

 

MANIMP course only:

The principles and procedures of competition law enforcement: Regulation 1/2003 and public enforcement by the EU Commission. 

 

Textbook:

R. Whish-D. Bailey, Competition Law, Oxford, tenth edition, 2021 (Maninp - 9 CFU Chapters 1-7; EPOS - 6 CFU Chapters 1-5 no paragraphs on the UK system)

 

Cases and materials:

Slides will be used during the course and will be available on the course's Moodle Platform upon subscription (they are not a substitute for the textbook though!)

Cases will be discussed from time to time in class and made available on the Moodle Platform.

The exam will be oral and will last approximately between twenty and thirty minutes. The student will be asked general open-ended questions on the main topics of the program. 

In order to pass the exam, the student will have to achieve a minimum mark of 18/30, showing at least a basic knowledge of the main topics.  In order to achieve  30/30 con lode, the student will have to show an excellent command of all the topics analyzed during the course, as well as being able to coherently connect them.
Besides, the student will have to show the capability to apply the theoretical notions, by being able to give examples or offer solutions which require the application of acquired notions to concrete examples and cases. 
The reference to case-law discussed during the course (for the students who attended it) will be taken into consideration

Ricordo agli studenti che il docente non ha facoltà di aprire discrezionalmente a tutti la partecipazione a questi appelli.

Possono parteciparvi gli studenti laureandi, fuori corso e portatori di DSA e coloro a cui il regolamento di ateneo lo consente. La ragione è che è un appello che si svolge nel pieno dell'attività didattica del semestre non è una normale sessione di esami.

Dall'a.a. 2007/2008 è professore ordinario di diritto amministrativo presso la Facoltà di Economia dell'Università La Sapienza, presso la quale ha insegnato diritto amministrativo, diritto amministrativo europeo, diritto amministrativo per il governo del territorio, diritto urbanistico, scienza dell'amministrazione.Dall'a.a 2010/2011 ha insegnato European Administrative Law e dall'a.a. 2016/2017 tiene il corso di Competition Law and Market Regulation. Dall'a.a. 2017/2018 è responsabile del corso diritto amministrativo, che attualmente tiene in co-docenza con il dott. Flavio Valerio Virzì (6 crediti prof. Chirulli- 3 crediti prof. Virzì).
Dall'a.a. 2000-2001 è stato professore associato di diritto amministrativo presso la Facoltà di Economia dell'Università La Sapienza, sede di Latina e sede di Roma.
E' componente del collegio dei docenti del dottorato in Diritto pubblico, comparato e internazionale, con sede presso la facoltà di Scienze Politiche dell'Università Sapienza, coordinatore prof. Fulco Lanchester, nell'ambito del quale coordina il percorso in Amministrazione pubblica europea e comparata.
Titolare dal 1995 al 2002 di un contratto integrativo per l'insegnamento ufficiale di diritto amministrativo I presso la LUISS Guido Carli di Roma.
Dal 1997 al 2000 ricercatore in diritto amministrativo presso il dipartimento di Teoria dello Stato della Facoltà di Scienze Politiche de La Sapienza.
Nel 1996 dottore di ricerca in diritto amministrativo presso la Facoltà di Giurisprudenza de La Sapienza.Ha svolto ricerca e pubblicato in materia di giustizia amministrativa, italiana e comparata, autonomia privata dell'amministrazione, privatizzazioni, servizi pubblici, urbanistica,contratti pubblici.Nell'ambito dell'attività di ricerca, ha svolto periodi di studio e di ricerca in Gran Bretagna a partire dal 1993, approfondendo particolarmente i temi della tutela giurisdizionale e della regolazione.
